Living Life Is About Making Choices

Throughout life we can make choices about a whole range of things that we wish to do, buy, participate in and engage.  We are all unique and we have different tastes, biases, perceptions and needs, and that’s OK because we are human after all.

In some instances when presented with choices one of the choices we can make is to NOT choose, and move on, blissfully without any risk or consequences. That’s an OK position to be in for many things.

There is one choice in life that we just don’t get to make, and it’s not really a case of If, but When, as it happens to us all. We are talking about Death, which is often a hushed subject, little spoken about until it happens in our circle of friends, family etc.

Choosing to make your Last Will and Testament now is a great “peace of mind” position to be in as it allows you to express your wishes about how events are to be handled When you are gone. Notice we didn’t say If you die, we said, When you die. That’s not being harsh or brutal, it’s being realistic but the agony that your survivors face is that they need to make arrangements for a whole host of affairs after you are gone and it can be a whole lot simpler if you have prepared the basic details for them.

You can choose to do this through your Last Will and Testament.

Many put off the task saying I will get around to that later, and its put off and put off.

"Many of us don't even have a 1st Will and Testament!"

From time to time we hear of situations where people have died without a last Will and Testament being created and as a result the immediate issues need to be handled by an external person or business that needs to extract from the survivors  the arrangements to be made.

When it comes to distribution of the estate this needs to be handled, (if you haven’t made a Will) under the laws of the land and you may find court orders are required to close out financial affairs and estate distribution. This can be a long drawn out and expensive process and isn’t what you probably would have wanted anyway. This is added grief and burden for your survivors.

A good starting place is the Last Will and Testament as it allows you to state what you want done with a wide range of aspects surrounding your situation and financial affairs and even allows you to specify who will look after minor children etc.

Drawing up a simple Will can be an expensive legal process that can range in cost anywhere from $AUD 75 minimum to $AUD 300 upwards depending on the conditions expressed in the Will.  To update your Will due to change in circumstances you then need to pay these fees again, and by that time they may have escalated.

SimplyWilling © is a simple software program that allows you to generate a properly constructed Will that allows you to enter all the relevant details about your wishes and views on how you want your estate to be handled after you have gone. It can be used within your immediate family to generate as many Wills as you like, as often as you like based on changes in circumstances for a single once only fee.

SimplyWilling © is offered as a once only licence fee of $US40 (approx $AUD 60) and allows you to save the Will and print the Will. For a Will to be Legal you need to print the Will, sign it in the presence of two witnesses who must not be beneficiaries to the Will, and then we suggest you lodge the Will in a safe place and tell your family and/or executors where it can be located.

Features

SimplyWilling © runs on Windows XP and Windows Vista

NOTE: If your affairs are likely to be complicated due to the following circumstances we suggest that you use a solicitor as Simply Willing is designed for most simple Wills. It’s tempting to save money by setting up your own will, but we recommend that you seek professional legal advice to create a Will if:

Should your situation cover more complex requirements, such as those listed above then we strongly recommend that you consult a professional adviser such as lawyer or solicitor or Wills expert to create a Will that specifically suits your circumstances.
